Smartflash BV (hereinafter referred to as Smartflash/SmartVibes/Speeddaten.nl), the data controller, offers through the website www.speeddaten.nl, an events platform for singles, where they are supported in making contact with other singles through participation in events. Additionally, it provides online dating services through the service Smartbeat. Online video speed dating services are also offered via the domain name speeddate.be. This data protection policy clearly outlines what data Smartflash processes from its users, how it aims to optimally protect the data of its users, and what rights the users can exercise. By using the website of Smartflash and the associated services, the user accepts the practices described in this data protection policy. The user should read the data protection policy thoroughly before using the services offered by Smartflash. I. Data Processing

  • Article 1. Consent

    1.1. By registering, the user gives his/her consent to Smartflash – and processors acting on behalf of or under the instruction of Smartflash – for the processing of his/her personal data. 1.2. If personal data are used for purposes that require the user’s consent, the user will always be asked for explicit, written consent.

  • Article 2. Data Collection

    2.1. In order for Smartflash to provide the services outlined in its General Terms and Conditions, it is necessary to collect and store the personal data communicated by the user during the registration process for as long as Smartflash deems necessary or until the user requests the deletion of this data.
    • The access to the platform Speeddaten.nl is via the email address provided by the user and the password chosen by him/her (login data).
    • At registration, the user must fill in several details, which are necessary for the fulfillment of the contract, which are individually marked as such. These mandatory details include:
      • Language;
      • Gender;
      • First name;
      • Last name;
      • City;
      • Mobile number;
      • Date of birth;
      • Email address;
      • Password;
      • Event the user wishes to participate in.
    • Additional data may also be requested at the time of registration, such as:
      • Occupation;
      • Children;
      • Educational level;
      • Desire for children;
      • Height;
      • How the user found SmartVibes.
    • In the context of a cancellation/refund, additional data may be requested, such as:
      • Reason for cancellation and/or refund;
      • IBAN bank account number.

  • Article 3. Use of Data

    Smartflash primarily collects data to provide the user with a safe, high-quality, effective, and personalized experience while using its services. The data is specifically used for the following purposes:
    • Keeping track of participants and guest lists for its events;
    • Contacting these individuals in the context of organizing its events;
    • Exchanging personal and contact details upon a match;
    • Informing about new events or other news from SmartFlash or its partners. The user may unsubscribe from the newsletter at any time by changing the preferences in his/her account;
    • Making adjustments and improvements to the Smartflash services;
    • Providing proper and/or optimal customer support;
    • Detecting and preventing unlawful acts or activities contrary to the General Terms and Conditions of Smartflash;
    • Developing or debugging the services of Smartflash.
    • Photos of event atmospheres may be used for external communication through its own channels (such as website and social media).

  • Article 4. Sharing with Third Parties

    4.1. When in the context of the services provided by Smartflash data is shared with other users, this is done exclusively under the name entered by the user. 4.2. Personal data is only shared with third parties unanonymized:
    • If necessary to provide the requested service (e.g., processing payments);
    • If the user has given his/her express consent (e.g., when publishing a success story);
    • When the sharing is permitted under the relevant legal provisions for a specific legally competent authority (e.g., in the case of a government investigation, police investigation, etc.).
    4.3. External service providers of Smartflash who provide services on behalf of and under the instruction of Smartflash, in order to enable the service provision, are not considered as third parties.

II. Data Security

    5.1. Through appropriate technical and organizational measures, maximum data security is sought. This is a means commitment on the part of Smartflash. All information entered by the user during registration or when logging into Speeddaten.nl is encrypted. This encryption seals the data transfer between the user’s internet browser and the webserver of Smartflash, thus preventing misuse of this data. The encryption technology used is SSL encryption.

III. Rights of the Data Subject

    6.1. Right of Access – Information

    Smartflash has tried to clearly outline its policy in this document. However, the user also has the right, through a written request at reasonable intervals, to obtain additional information about the data stored for his/her person at Smartflash, their origin, the purpose for which they are stored, and the recipient to whom the data are disclosed.

    6.2. Right to Object

    The user retains the right to withdraw the given consent at any time, either in whole or in part, which may lead to the inability to further use the services of Smartflash. Moreover, the user has the right to object to the use of his/her data for direct marketing purposes.
